March 28 Update: Assemblyman Muratsuchi ordered the SOS to resolve this. The SOS called me promised that next week they will send me any oaths which were filed but missing from the February package. Also, Assemblyman Chris Ward provided his oath for 2025 – 2026, but no one else has as of yet. I have been following up via phone and emails.
Update on March 17, 2025: On March 10, I emailed everyone at the State Senate that I’d requested oaths on (from the Senate Rules Committee) and said they needed to send me their oaths by the end of the day or I’d notify Federal Attorney General Pam Bondi. None of them sent their oaths. Between March 11 and 17, I sent this tweets to the legislators: “The SOS does not have an oath on file for you for the 2025 – 2026 session. Please post your oath on X to prove you are lawfully employed.” and copied Pam Bondi. Still no response as of yet. I also sent a message to Bondi via the DOJ website.
Quick summary: I requested oaths on 100 people. It could be a mistake, but it looks like not one Assemblyman, State Senator or staffer filed oaths for the 2025 – 2026 legislative cycle. Lt. Governor Kounalakis also doesn’t have a current oath. I am asking you all for help to confirm whether or not oaths were filed.

On January 31, 2025, I requested copies of oaths and bonds from the Secretary of State for 100 people, for many elected officials and deep state staff, including Scott Wiener: page 1, page 2 and page 3.
On February 5, 2025, the SOS responded via email that they had 126 oaths and no bonds on file. Just as oaths are required by law for every government employee, so are bonds, so everyone on the list is working unlawfully. However, as far as I can tell, the only punishment for not having a bond is dismissal; lack of bonds is not a felony like lack of oaths.
The SOS only takes payments via paper checks. I mailed a check right away, but it took a while to clear my bank. The SOS sent the response package via snail mail. The cover letter is dated February 10, but the package wasn’t mailed until February 19. I received it on Tuesday, March 4. Images of the cover letter are at the bottom of this post.
Interestingly enough, Scott Wiener and several others filed old oaths that were already expired. This indicates to me they are trying to cover their butts. However, the law clearly states that the oaths are to be filed within 30-days of taking office — to file an oath after it has already expired doesn’t change the fact that they were working unlawfully during that term.
Shockingly, it appears that of the 100 people that I requested oaths for, not a single oath has been filed for the 2025 – 2026 legislative term by State Senators, Assemblyman or their staffers. This could be an error. I sent an email to the SOS asking for confirmation that there are no current oaths filed. The SOS said it was possible there was a gap between the filing date and the SOS recording date. However, it is hard for me to believe that in the 4.5 weeks that had lapsed between the filing deadline and the SOS response, that all of them fell into that gap.
Lt. Governor Eleni Kounalakis also does not have a current oath on file. Since her oath was supposed to have to been filed in January 2022, she definitely did not fall into the gap. Prima fascia evidence indicates that the failure to file for this session is not an error:
On Wednesday, I sent an email to all the people whose oaths I’d requested from the State Senate back in December 2024. The State Senate has violated the law by never providing those oaths. In the email, I notified them that it appears they are currently unlawfully employed and thus committing a felony. I asked them to prove that they were lawfully employed by sending me a copy of their oaths. None did. I sent another email on Friday morning. No response as of yet.
On Wednesday, I spoke with Regina Alimar in the Secretary of the Senate office (Erika Contreras’s office) and explained the oath situation. On Thursday, I called back to follow up. Regina said she had passed the message on (she didn’t say to whom) and she herself had not gotten any information as to whether the lack of filing from the State Senate was intentional. I have not gotten a return call or email as of yet.
On Wednesday, I also spoke with Jehovana Sanchez Gonzalez in Senate Operations (John Nam’s office) and explained the oath situation to her. On Thursday, when I called to follow up, I lucked out out and John Nam answered the phone. Mr. Nam stated that he did not get the message from Jeovana and appeared to not know what I was talking about (despite the fact that he had gotten the email I’d sent the day prior). Mr. Nam said he’d look into it and get back to me. Mr. Nam did not say that the oaths had been filed. Mr. Nam did not offer to send over the oaths in accordance with the LORA request that is now almost three months past due, nor did he mention sending the oaths in the future. I have not gotten a return call or email as of yet.
On Wednesday, I left a voicemail message at HR for Lynn Cervinka and Sheila Braverman. On Thursday, I called to follow up. The person who picked up the phone immediately hung it up without saying a word. When I called back, it went to voicemail and I left a message. I have not gotten a return call or email as of yet.
On Wednesday, I called Scott Wiener’s San Francisco office and explained the situation. The person I spoke with said he’d look into it. Then I called the Sacramento office. The person I spoke with was unfamiliar with the situation. When I asked to be transferred to someone who was familiar with it, the person he transferred me to laughed at me (it actually sounded like multiple people laughing) and then slammed the phone down. On Thursday, I called the San Francisco office to follow up. I spoke with Dominic, who said that antiquated laws don’t apply to Mr. Wiener.
On Wednesday, I spoke with Barbara Mohondro in Mike McGuire’s office. She asked what I expected her to do. I told her that the entire state senate is currently illegitimate and it is Mr. McGuire’s responsibility to make it legitimate. She said she’d look into it and get back to me in a few days.
At this point, it is looking like the lack of filing by the State Senate is intentional. This means our entire legislature is fraudulent and must immediately cease operation. But why would every legislator choose not to file an oath?
Not taking and filing an oath is a penalty punishable with up to three years in prison. Treason of oath is a felony punishable up to and including death.
Given that the Trump administration views the California legislature’s protective view regarding undocumented migrants to be treason of oath, I believe that the reason no oaths were filed with the SOS is because the California legislature as a collective has taken a calculated risk: they have decided that if they are prosecuted for standing up for the migrants, they want their punishment to be 3 years in prison for not taking the oath vs death for committing treason of oath.
The problem with this strategy is that our entire current government is illegitimate and must immediately cease operations.
Please help me verify whether or not oaths have been filed, and if not, whether all the legislators are in on the conspiracy . Please call your own state senator and assemblyman and tell them there seems to be an issue with oath filing this year. Ask them if they have filed an oath, and if so, ask who filed it on their behalf and for a copy of the allegedly filed oath. Please forward the information on to me.
