The blog has been quiet lately because I’ve been so busy with the case that I haven’t had time to update the blog. On Monday, May 24, 2021, I filed another Motion to Compel Further Information, this time on Specially Prepared Interrogatories #001: Clarification of FTB’s Policies and Procedures. The Motion + exhibits was 495 pages. It’ll take me a long time to redact and upload them all, but I will get it uploaded eventually.
On May 28, 2021, there was a hearing on my first Motion to Compel Further Information for Additional Documents. In FTB’s Opposition to Motion that they filed with the court, Deputy Attorney General Anna Barsegyan made numerous deceptive and several outright false statements to the judge!
During the Oral Arguments at the hearing, I called her out on all her lies and deceptions. I accused her of deliberately trying to deceive the judge in order to cover up her client’s criminal activities. Fortunately, I had already submitted all the proof with the new Motion to Compel, so I was able to reference the exhibit numbers that documented her lies. In her rebuttal time, Ms. Barsegyan simply repeated the same lies that I had just debunked, as if repeating a lie somehow makes it true.
The judge was furious with me. He asked me if I understood the implications of calling her a liar. I said I did, and explained that I had already filed an Accusation against the attorney that represented FTB in the Office of Tax Appeals Case (the predecessor to this case) and that while the CA Supreme Court chose not to hear the case, the CA Auditor’s Office has opened an investigation based on my allegations.
The false arguments that Ms. Barsegyan made are what FTB normally uses in its court cases. I am hoping that other people who have pending cases against FTB right now can use my arguments to win their respective court cases. More specific details of why the statements are fraudulent are in the post titled “Fraudulent Statement By FTB Regarding Demand Penalties.” Here is the list of laws that I referenced. Good luck!
Edit to add: I imagine at this point, the FTB/Attorney General/State of CA are pretty desperate to shut me up. For the record, I am NOT suicidal. I do NOT have depression issues. I am a careful driver, I don’t use drugs of any sort (not even aspirin), I don’t drink much, I am a super healthy eater, and my husband and I live a wholesome life. If something out of character springs up, know that the FTB/Attorney General/State of CA is behind it.
