I have filed an Accusation with the California Supreme Court against Eric Yadao, who is employed by the Franchise Tax Board as an attorney (part 1, part 2).
An Accusation is basically a request to revoke Mr. Yadao’s license to practice law because of unethical and/or unlawful behavior.
In this Accusation, I clearly detail that FTB is running multiple embezzlement and racketeering schemes, and that they are also overcharging interest. On pages 5 – 20, I detailed how the schemes work. On pages 4 – 16, I listed the legal codes that these schemes violate and why. On pages 23 – 38, I showed exactly how Mr. Yadao covered up FTB’s unlawful activities via improper redactions, improper omissions, false arguments and false statements..
On pages 9, 21 – 22 and 34, I also point out how the Office of Tax Appeals (OTA) covered up this criminal activity with their blatantly corrupt Opinion (aka verdict). On pages 20 – 23, 30 and 34, I point out how the CA Bar Association also covered up the criminal activity. On pages 18 – 20, I explain how FTB targets the most vulnerable.
If you are religious, please pray that the Supreme Court grants this Accusation Review. They have the right to decline it. Quite frankly, my guess is that the judges will be pressured by Governor Newsom and State Controller Yee, amongst others, to sweep this expose’ under the rug by declining the case.
This is a State-Level government corruption scandal that affects every Californian who makes estimated tax payments (including the self-employed, 1099 workers, some retirement incomes,and investment income), who may ever file their returns late, and who may ever be in collections (FTB is the collection agent for most CA and some federal government agencies, including the DMV) . Please share this info with everyone who pays taxes to CA so that we can put pressure on the State legislators to stop exploiting their own taxpayers.
