2018 Annual Taxpayer Bill of Rights Requests

As I was updating my latest posts with links to older posts, I realized I had never posted about the 2018 Annual Taxpayer Bill of Rights Meeting. Here is the text of the speech that I made and this is the video:

Due to the time limitations on the speech, the written requests are much more detailed than the oral requests. Here are written requests 1 – 6 and here are 7 – 8. This addendum contains a letter signed by Christopher Calhoun in which I believe he committed fraud and violated my taxpayer rights. This second addendum contains an email chain between myself and Susan Maples in which I believe she committed fraud and violated my taxpayer rights.

Here is FTB’s response. I believe that Susan Maples also committed multiple counts of fraud in this response.

Note: I am not suicidal, I don’t have depression issues, I am a careful driver, I rarely drink alcohol, and I do not use drugs of any kind (not even aspirin). My family lives a wholesome life. If something happens to me or my family that is out of character for us, we were set up by the State of California as revenge for exposing their crimes.

We immediately launch into content with virtually no chit chat. I give a quick recap of what we’d discussed in the previous episode.

At 2:00, I read off the names of the legislators who do not have current oaths on file with the SOS.  Here is a list of oath laws. In a nutshell, not swearing an oath is a penalty punishable with three years in prison. However, government employees will choose not to take oaths if they know they are going to be committing treason of oath, which has a more severe penalty.  Here are all of the oaths that I have collected from CA state level government employees. Charlee Simons of “Do Not Talk” Had Me Back to Talk About Oaths, Signing Up Migrants for ITINs and FTB’s Disguising Criminal Schemes as Customer Service Failures

I come on at the 4-minute mark and we greet one another and talk about the previous episode we did together.

At 5:15, I give the background information about oath laws and explain why government employees choose not to take oaths.

At 6:30, I read the names of the legislators that the Secretary of State confirmed do not have a current oath on file for 2025 – 2026. Here are all of the oaths that I have collected. Scroll all the way down to nearly the bottom for the State Assembly and State Senate. 

At 9:00, I talk about my next strategy: Since it is illegal to pay government employees who don’t have fully executed oaths, I plan to contact State Controller Malia Cohen to ask her to halt pay on these people and claw back funds already paid.

Following the Money… FTB Has Disclosed Some Things That Have Warranted a Deeper Dig…

Summary: FTB has increased its budget by $35 million a year for customer service staff — but it doesn’t appear they’ve hired any more staff and their customer service numbers are getting worse.

2023: FTB Admits Failures and Increased Budget

In March 2023, FTB admitted that penalties and fees were being falsely imposed as a result of customer service failures. They didn’t outright say this, but they also implied that wage garnishments, liens and levies were also being falsely imposed due to these customer service failures.

FTB requested a $25.23 million per year budget increase in order to correct these customer service issues. FTB had stated that they intended to hire more customer service agents and give raises and bonuses to the existing staff.

FTB’s 2024 Annual Taxpayer Bill of Rights (ATBOR) Meeting

The speech was limited to 5 minutes, so it was short and succinct. This is the text of the speech. The written submission is long and detailed, and includes links to proof of the allegations made. FTB’s response is here*.

This year, I’ve also made three legislative change requests: 1 treat married couples as a single tax entity. This has more details on exactly how the married couple embezzlement/racketeering scheme works that I’d referred to in the speech. 2. Repeal 1917C2 as it violates our right to protest. 3: Remove the loophole that lets FTB evade our right to due process.

Certificate of Default Has Been Served to the CA State Senate for Failing to Remove Scott Wiener and Other Unlawful Employees

April 2025 update: Scott Wiener has filed an oath with the SOS for 2025 – 2026, but it does not change the fact that all his work from the years he was working without an oath must be voided.

Important News!

State Senators Steven Bradford, John Laird, Nancy Skinner and Susan Talamantes Eggman, as well as Assemblyman Joaquin Arambula, are also working unlawfully without a current oath on file with the Secretary of State (SOS).  Each of their individual oaths is on my oaths page; scroll all the way down to nearly the bottom to find their names.

The SOS also confirmed that Scott Wiener still hasn’t filed an oath. At this point, there is no denying this is intentional criminal malfeasance. Please sign my petition to have him vacated from office and his legislation voided.

Signing the petition is important so that we have a ledger of who does not consent to the crime of legislators working unlawfully. Calling has even more power, so please also call daily (phone numbers at the bottom of the post).

The Certificate of Default

On September 26, 2024, a Certificate of Default (pages 1 – 18 and pages 19 – 35), which is step 3 in the Common Law legal process, was served to four people: Secretary of State Senate Erika Contreras, Deputy Secretary of State Senate John Nam, State Senate Human Resources Executive Sheila Braverman and State Senate Human Resources Executive Lynn Cervinka for conspiring to allow 20 + people to work unlawfully without oaths and bonds. Another Authority to Report Government Corruption/Summary of My Work

I’ve posted many times about filing reports of government corruption to various authorities. Basically, whenever I see a claim that a particular branch of government handles such matters, I file a complaint with that agency.

The People’s Operation Restoration recently posted this to their Telegram Channel:

FTB June 2024 Board Meeting: Spending Our Tax Dollars to Stalk Us, Remove Kids from Homes and Pay Illegals; Probably Still Improperly Imposing Penalties

I wanted to bring three items of concern regarding how the State of California spends our tax dollars. At the Franchise Tax Board’s June 24, 2024 Board Meeting, they discussed:

I. Items 5B and 6: Cal EITC Credit as a stalking tool

I have posted before about California’s obsession with getting people to file tax returns, even when they do not make enough money to be required to file tax returns. One of the ways that FTB tries to get people to file is by offering “carrots.” 

Their biggest carrot is called Cal EITC and it is basically money back. People can get money back from the state even if they didn’t pay any income taxes in the first place. The State of California has a budget of $1.1 billion for this incentive.

Fifth ORIM Claim Filed! This One is Also Against FTB Board of Directors and Executives for Refusing to Disclose Policy and Procedure Surrounding NPAs

Quick background: Every government employee is required to take an Oath and to have an insurance policy or bond. ORIM is the insurance agency for State of California employees. For those of you who are looking to file your own claims, here is info on how to do so. Before you order an oath, check to see if I already have it posted. If you would like some models to follow, here is the firstsecondthird and fourth claims that I’ve filed.

I have Accused fifteen individuals from four different agencies of violating my rights under California Right R&TC Section 21006(b)(2) and for violating 18 USC §1001 (a)(1) by refusing to disclose FTB’s policies and procedures regarding the issuance of Notice of Proposed Assessment (NPA) forms and processing of Protests to said NPA forms. 

For several years now, I have been asking FTB to disclose the laws which justify 1. Not applying all payments made on the NPA form and 2. Denying the Taxpayer Right to Protest on the basis that the NPA does not reflect the full funds collected by FTB. FTB has been continually evasive and continually fails to provide the relevant statutes. It appears to me that NPAs being falsely issued is a lynchpin to the accounting fraud schemes.
